This policy describes the types of information we may collect from you or that you may provide when you visit the website www.modeone.io (our “Website”), our webapp relay.modeone.io and other ModeOne websites (our “Framework”), or mobile app (our “App” and together with the Website and Framework, our “Services”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • On the Services.
  • In email, text, and other electronic messages between you and the Services.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by ModeOne or any third party (including our affiliates and subsidiaries); or
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Services.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Services, including information:

  • By which you may be personally identified, such as name, e-mail address, or telephone number (“personal information”);
  • That is about you but individually does not identify you; and
  • About your internet connection, the equipment you use to access our Services, and usage details.

 

When you use the App, we collect:

  • Information you provide or allow access to through this app, such as your name, email address, phone number, SMS/MMS messages, call logs, and contacts. We will not use this information to contact you for any reason unrelated to your use of the App, nor will we share this contact information with any third party unless explicitly asked to by you or required by law. As instructed by your legal team, the App may collect your SMS and/or MMS messages, phone number, SMS log information, contact names, and corresponding Gallery items if available and upload them securely to our cloud Framework. Only your legal team has access to review this data for your legal matter. Once reviewed or exported, your legal team can permanently delete the data.
  • Analytics information provided by Google and the Google Play Store, which may include your device model, carrier, system configuration, and other interactions with the App. We use this information to improve the App.

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies.
  • From third parties, for example, our business partners.

Information You Provide to Us 

The information we collect on or through our Services may include:

  • Information that you provide by filling in forms on our Services. This includes information provided at the time of registering to use our Services, subscribing to our service, or requesting further services. We may also ask you for information when you report a problem with our Services.

Information that we collect through the App is used solely to facilitate your use of ModeOne for evidence backup and collection and to assist us in improving our service. We do not use your information for any unrelated commercial purposes. Except where required by law, we will not share your information with any third party other than our app and the platform. The only parties with access to your information are you and your legal team. We will retain your device information and all associated documents for as long as directed by your legal team. If you wish to permanently delete your information from our servers, please send an email to info@modeone.io. We will delete your information within a reasonable time after receiving your request. We will also retain any information required under applicable laws.

Disclosure of Your Information

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of ModeOne’s, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by ModeOne about users of our Services is among the assets transferred.

  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Promotional Offers from ModeOne. If you do not wish to have your email address used by ModeOne to promote our products and services, you can opt-out by sending us an email stating your request to privacy@modeone.io. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Accessing and Correcting Your Information

You can review and change your personal information by sending us an email at privacy@modeone.io to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

State Privacy Laws

We do not meet the conditions as outlined in Section 1798.140 of the California Consumer Privacy Act of 2018 (the “CCPA”) and therefore are not subject to CCPA requirements. We also do not meet the eligibility conditions outlined in the Virginia Consumer Data Protection Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, the Oregon Consumer Privacy Act, the Texas Data Privacy and Security Act, and the Montana Consumer Data Privacy Act, or the Florida Digital Bill of Rights and are therefore are not subject to the requirements of these laws. ModeOne has taken strong measures to protect the security of your personal information and to ensure that your choices for its intended use are honored. We take strong precautions to protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

Your e-commerce transactions are safe and secure. When you access your personal account information, you’re utilizing secure server software SSL, which encrypts your personal information before it’s sent over the Internet. SSL is one of the safest encryption technologies available.

ModeOne strictly protects the security of your personal information and honors your choices for its intended use. We carefully protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

Your personal information is never shared outside the company without your advance permission. Inside the company, data is stored in password-controlled servers with limited access. Your information may be stored and processed in the United States or any other country where ModeOne, its subsidiaries, affiliates or agents are located.

You also have a significant role in protecting your information. No one can see or edit your personal information without knowing your username and password, so do not share these with others. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

Children Under the Age of 13

Our Services are not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Services. We do not knowingly collect personal information from children under 13.
